Acceptance and services
These draft terms address use of growmark.online and potential engagements for website development, website maintenance, software development including IT consulting, and software maintenance. Service-specific obligations should be defined in a signed proposal or service agreement.
Quotes, scope and changes
Displayed starting prices are indicative, not a binding offer for an unlimited scope of work. Each project should define deliverables, assumptions, payment terms, timeline and approval process. Changes outside agreed scope may require a written change order and additional charges.
Client responsibilities
Clients should provide accurate requirements, content, timely approvals, legal rights to materials supplied, and appropriate access to systems. Never send passwords through ordinary contact forms or email; agree on secure credential-sharing methods.
Payments and recurring work
Invoices, deposits, milestones, renewal dates, late-payment consequences and cancellation conditions should be defined in the applicable agreement. Monthly maintenance and one-time development are different billing models; the service contract should clearly identify which applies.
Third-party services
Hosting, domains, CMS platforms, plugins, APIs, payment services and other third-party tools may be subject to their own terms, service levels, fees and availability. Responsibility for those costs should be documented in writing.
Intellectual property and licenses
Ownership of custom deliverables, pre-existing components, open-source software, licensed assets and source code access should be specified in the project agreement. Do not assume all software or assets are transferred merely because a project is paid for.
Warranties and limitations
Technical services involve dependencies and changing environments. Any warranty, support response commitment, service-level agreement, liability limitation or exclusion must be negotiated and drafted consistently with applicable law. This page does not create an uptime guarantee or guaranteed business outcome.
Termination and disputes
Termination rights, data handover, outstanding fees, dispute procedures and governing law should be stated in the executed agreement. Mandatory legal protections remain applicable notwithstanding any conflicting clause.
